We, the People’s United Democratic Movement, here in after referred to as PUDEMO declare ourselves to the world and the people of Swaziland that we are a political organization formed by the people of Swaziland and officially launched on the 7th July 1983 to unite and mobilize the oppressed majority of the Swazi people against the minority oppressive and exploitative tinkhundla rule. PUDEMO is a movement of the people committed to the creation of a free and democratic Swazi society. Our democratic commitment is founded on our firm belief that the pride of our sovereignty, freedom and unity, should be based on the respect of the will of the people.

We are committed to the restoration of a culture of respect for human dignity and the creation of a caring and prosperous society and the establishment of respect for, and acceptance of the legitimacy of all state structures; through the attainment and sustenance of an improving quality of the life of the people.

PUDEMO is, therefore, a democratic, non racial, non sexist political movement, committed to the creation, protection and promotion of a constitutional multi-party democracy, a transparent and accountable government, an environment conducive for growth and development

The PUDEMO, through this constitution and the Manifesto, commits itself to stand by the Swazi people in the struggle to return this, our beloved country to democratic governance which shall guarantee, ensure and protect majority participation with all civic rights protected as per the United Nations Universal Declaration of Human Rights, All Africa Charter on Human and People’s Rights and other relevant international conventions.


THE MISSION OF PUDEMO

The People’s United Democratic Movement (PUDEMO) is a political movement committed to the creation, protection and promotion of a constitutional multi-party democracy, a transparent and accountable government, an environment conducive to the economic growth and empowerment and the development of a culturally vibrant and tolerant society, based on maximum participation and the respect of the will of the people.

PUDEMO shall be guided by the ideals of the People’s Manifesto which is a set of goals to be achieved by the government in carrying out its historic mission of destroying the foundation of tinkhundla oppression and building a new and democratic society.


ARTICLE 1: Name and Registered Office

1.1 The name of the organization as constituted by provisions of the constitution shall be The People’s United Democratic Movement (PUDEMO).

1.2 The registered office of the movement shall be at such place as shall be decided, from time to time, by the National Executive Committee.


ARTICLE 2: Objectives

The People’s United Democratic Movement commits itself to;
2.1 The restoration and maintenance of constitutional parliamentary multiparty democratic governance through maximum popular participation and respect of majority will.

2.2 Protect, guarantee and ensure the observance of human rights through a Bill of Rights, which shall be enshrined in a people driven national constitution that is in accordance with the United Nations Declaration of Human Rights, the Africa Charter on Human and People’s Rights and other relevant United Nations conventions.

2.3 Advance the social, economic and political interests of the people of Swaziland as enshrined in the People’s Manifesto.

2.4 Uphold the principle of separation of powers thus ensuring the independence of the judiciary and fair legal practice.

2.5 Represent the Swazi nation wherever and whenever required, and to promote friendship, co-operation and fraternal understanding based on the respect sovereignty and independence.

2.6 Fight for the eradication of corruption, exploitation, nepotism, and all forms of unfair discrimination.


ARTICLE 3: MEMBERSHIP

3.1 Membership of PUDEMO shall be open to all Swazi citizens aged 18 years and above regardless of race, colour, sex, religion or social status.

3.2 The General Congress shall determine membership and or subscription fees from time to time.

3.3 Membership to PUDEMO permits each individual member to all the rights and obligations as enshrined here in.


ARTICLE 4: Organs of PUDEMO

4.1 The General Congress
4.1.1 The General Congress shall be a Congress of Delegates elected and mandated by the members of PUDEMO through its constituent structures.

4.1.2 It shall be the supreme policy making body of PUDEMO whose functions shall be to:
4.1.2.1 Formulate and articulate policies of PUDEMO
4.1.2.2 Formulate and alter operational by-laws and regulations.
4.1.2.3 Amend PUDEMO’s constitution.
4.1.2.4 Elect by secret ballot the Central Executive Committee, the Secretary for International Affairs and the three additional members.
4.1.2.5 Discuss and approve the budget of PUDEMO.
4.1.2.6 Receive and discuss reports from the General Secretary and Treasurer General.
4.1.2.7 Determine the nature and amount of the remuneration to be given to any officers of PUDEMO from time to time.
4.1.2.8 Receive the political report from the President.

4.2 The Extra-ordinary Congress
4.2.1The Extra-ordinary Congress shall be constituted in the
same manner and exercise all the powers and obligations
stated in Article 4.1. and elsewhere in this Constitution.

4.2.2 The extra-ordinary congress shall be held in the same
Manner as above, for Regions and Sub-Regions if and
when a need arise.

4.3 The National Mid-term Conference

The National Mid-term Conference shall comprise the whole National Executive Committee, Delegates elected by the Regions and the whole National Executive Committees of the Youth League and of the Women’s League.

4.3.1 It shall review and update the existing policies and programs and consider any new initiatives for final decision and adoption by the General Congress or Extra-ordinary Congress
4.3.2 Shall convene extra-ordinary congresses
4.3.3 Shall from time to time deploy and redeploy and/ or disband sub-structures and sub-committees if and when a need arise.

4.4 The Regional Congress

The Regional Congress shall be a Congress of Delegates elected by the registered membership of PUDEMO at the Regional level according to their numerical strength whose functions shall be;

4.4.1 To debate, either directly or through its constituent structures, proposed policies of PUDEMO.

4.4.2 To implement directly or through its constituent structures the approved policies and programs of PUDEMO.

4.4.3 To elect and give mandate, through its constituent structures, to the delegates who shall represent the region at General Congress.

4.4.4 To consider any other matters referred to it by the Regional Executive Committee or other relevant organs of PUDEMO.

4.5 The Sub-Regional Congress

The Sub-Regional Congress shall be a Congress of Delegates elected by the registered membership of PUDEMO at the Sub-Regional Level according to their numerical strength, whose functions shall be;

4.5.1 To debate, either directly or through its constituent structures, proposed policies of PUDEMO.

4.5.2 To implement directly or through its constituent structures the approved policies and programs of PUDEMO.

4.5.3 To elect and give mandate, through its constituent structures, to the delegates who shall represent the region at General Congress.

4.5.4 To consider any other matters referred to it by the Sub-Regional Executive Committee or other relevant organs of PUDEMO.

4.6 The Branch Annual General Meeting
4.6.1 Each of the designated Regions shall establish as many branches as necessary for the purpose of recruiting, educating and mobilizing the people towards the realization of the goals and objectives of PUDEMO.

4.6.2 The Branch Meeting shall comprise the registered membership of PUDEMO at Branch level and such meeting shall be held at least once every three months.

4.6.3 The Branch Meeting shall debate proposed policies, discuss and implement the approved policies and programs of PUDEMO at Branch level.

4.6.4 The Branch Meeting shall elect and give mandate to the Branch Committee.

4.6.5 It shall consider any matter referred to it by the Branch Committee or any other relevant organ of PUDEMO.

4.6.6 Branches shall convene annual general meetings to receive, discuss and adopt the reports of B.E.C as in Regional General Congress.

4.7 The Central Executive Committee (CEC)
4.7.1 The Central Executive Committee, here in after called the “ CEC”, shall be the executive arm of PUDEMO responsible for the execution of the resolutions of the General Congress, policy implementation and the day to day running of PUDEMO.

4.7.2 The CEC shall be responsible to the General Congress.

4.7.3 The Central Executive Committee shall be duly constituted by; the President, the Deputy President, the Secretary General, the Deputy Secretary General, the Treasurer General, the National Political commissar, and the National Organizing Secretary.

4.7.4 The Central Executive Committee shall oversee the affairs and general running of PUDEMO.

4.7.5 It shall receive reports from the National Executive Committee (NEC), National General Council (NGC) and duly execute them in accordance with the policies of PUDEMO.

4.7.6 It shall act as a disciplinary body on matters referred to it by the NEC, NGC and shall refer matters of a more serious nature to the General Congress.

4.7.7 It shall meet once a month

4.8 Duties of Members of the Central Executive Committee

4.8.1 The President shall;
4.8.1.1 Preside over all meetings of the Central Executive Committee and the CEC. He/she shall preside over all meetings of the General Congress, Extra-ordinary Congress, and the National Mid-term Conference of PUDEMO.
4.8.1.2 Be the representative of PUDEMO on matters of policy both domestically and internationally.
4.8.1.3 Sign minutes of all meetings stipulated above after they have been passed as correct.
4.8.1.4 Delegate any of the above duties whenever s/he is unable to execute them.
4.8.1.5 Perform any other duties as required by the NEC, General Congress, and standing orders.

4.8.2 The Deputy President shall
4.8.2.1 Exercise all the powers and perform the duties of the President whenever s/he is absent or incapacitated. If both the President and Deputy President are absent or incapacitated, the Central Executive Committee shall appoint anyone of its members to act.
4.8.2.2 Preside over all meetings of the National General Council.
4.8.2.3 Sign minutes of all meetings of the NGC after they have been passed as a correct record

4.8.3 The Secretary General shall;
4.8.3.1 Be responsible for the general administration of PUDEMO and the maintenance of all records.
4.8.3.2 Be responsible for the general conduct of PUDEMO’s business and for giving effect to instructions of the General Congress and the NEC.
4.8.3.3 Prepare and give reports on the general performance and related activity of PUDEMO to the NEC, and General Congress.
4.8.3.4 In conjunction with the President, convene meetings of the Central Executive Committee, National Executive Council, General Congress, Extra-ordinary Congress; send notices and agenda, and record the proceedings of such meetings.
4.8.3.5 Be the spokes person and public relations officer of PUDEMO.
4.8.3.6 Whenever necessary, represent PUDEMO on matters of policy both domestically and internationally in conjunction with the President.
4.8.3.7 Be signatory to all PUDEMO’s financial accounts.


4.8.4 The Deputy Secretary General

4.8.4.1 Shall deputize the Secretary General and carry other functions entrusted to the office by the NEC.
4.8.4.2 Shall be responsible for recruitment, capacity building and cadreship development in PUDEMO at National Level.

4.8.5 The Treasurer General shall;
4.8.5.1 Be responsible for the overall financial administration and up to date maintenance of the financial books of PUDEMO.
4.8.5.2 Shall prepare an annual statement of account, which shall be audited by an accredited firm of auditors as shall be appointed by the General Congress.
4.8.5.3 Campaign for funds both domestically and internationally for the purpose of meeting objectives of the movement.
4.8.5.4 Prepare and present a financial statement to the NEC, or as requested by the National General Council.
4.8.5.5 On receipt, deposit all funds of PUDEMO into its bank account within three days of receipt thereof.
4.8.5.6 Be signatory to all PUDEMO’s financial accounts at national level.

4.8.6 The National Organizing Secretary shall;
4.8.6.1 Be responsible for the co-ordination of all the structures and of PUDEMO and activity on the ground.
4.8.6.2 Present reports to the NEC.
4.8.6.3 Be the chief convener of the National General Council.
4.8.6.4 Co-ordinate the work of Regional Organizing Secretaries

4.8.7 The National Political Commissar shall;
4.8.7.1 Be responsible for cadreship development and capacity building programmes of PUDEMO.
4.8.7.2 Coordinate the work of cadreship development and training with regional commissars.
4.8.7.3 Organize cadreship schools and capacity building workshops at national level.
4.8.7.4 Be responsible for gender work in the movement.
4.8.7.5 Present a report of work done to the NEC.

4.9 The National Executive Committee (NEC)

4.9.1 The National Executive Committee shall be duly constituted by; the President, the Deputy President, the Secretary General, the Deputy Secretary General, the Treasurer General, the National Political Commissar, and the National Organizing Secretary, Secretary for International Affairs, the three Additional members directly elected by General Congress, the Presidents and Secretary Generals of the Youth League and Women League, the chairpersons and Secretaries of the five regions of PUDEMO.

4.9.2 The National Executive Committee shall;
4.9.2.1 Meet once in two months to discuss progress reports of all the Structures of PUDEMO and the Programme of Action.
4.9.2.2 Require a two-third-majority of its membership to start a meeting or to take any resolution.
4.9.2.3 Meet to discuss any issues referred to it by the NGC, and the Regional Executive Committees.
4.9.2.4 Discuss, plan and implement campaigns.

4.10 The Regions of PUDEMO
4.10.1 There shall be five Regions of PUDEMO, namely Hhohho, Lubombo, Shiselweni, Manzini and External Regions
4.10.2 There shall be three sub-regions per region, namely the Northern, Central and Southern Sub-Regions of PUDEMO.

4.11 The Regional Executive Committee (REC)
4.11.1 There shall be an elected Regional Executive Committee in each of the regions in the country.

4.11.1.1 The Regional Executive Committee, here-in-after called the REC, shall be constituted by the Regional Chairperson, Regional Vice Chairperson, Regional Secretary, Regional deputy Secretary, Regional Treasurer, Regional Commissar and Regional Organizing Secretary.
4.11.1.2 The Regional Chairperson and Secretary of the Youth and Women’s League shall be ex-officio members of the REC.
4.11.1.3 The REC shall be responsible for the operations and activities of PUDEMO at Regional Level.
4.11.1.4 It shall meet once a month.

4.11.2 Duties of Members of the Regional Executive Committee
4.11.2.1 The Regional Chairperson shall;
4.11.2.1.1 Preside over all Regional Executive and Regional Congress or meetings.
4.11.2.1.2 Be the official representative of PUDEMO on regional policy matters.
4.11.2.1.3 Sign all minutes of the REC and regional meetings after they have been passed as correct.
4.11.2.1.4 Delegate any of the above duties whenever s/he is unable to execute them

4.11.2.2 The Deputy Chairperson shall;
4.11.2.2.1 Exercise all the powers and perform the duties of the Regional Chairperson whenever s/he is unable to act. In the event that both are unable to attend, the REC shall appoint anyone of its members to act.

4.11.2.3 The Regional Secretary shall;
4.11.2.3.1 Be responsible for the general administration and maintenance of PUDEMO records at regional level.
4.11.2.3.2 Be responsible for the general conduct of the business of PUDEMO at regional level and for giving effect to the instructions of the REC and the Regional Congress.
4.11.2.3.3 Prepare and give reports on the general performance of PUDEMO at regional level to the REC and the Regional Congress.
4.11.2.3.4 Be responsible for the general correspondence of PUDEMO on regional matters.
4.11.2.3.5 In liaison with the Regional Chairperson, convene meetings of the REC and Regional Congress, and send notices, agenda and record proceedings of such meetings.

4.11.2.4 The Regional Deputy Secretary shall;
4.11.2.4.1 Deputize the Regional Secretary and carry duties entrusted to the office by the REC.
4.11.2.4.2 Be responsible for recruitment, capacity building and cadreship development in the region.

4.11.2.5 The Regional Treasurer shall;
4.11.2.5.1 Be responsible for the overall financial administration and up to date maintenance of financial records and statements of PUDEMO at regional level.
4.11.2.5.2 Prepare and present annual statements of account to the REC and the Regional Congress which shall be approved by an accredited firm of auditors as appointed by the REC.
4.11.2.5.3 Organize and be responsible for fundraising activity at regional level.
4.11.2.5.4 Be signatory to all financial books of account at regional level.
4.11.2.5.5 On receipt, deposit all funds of PUDEMO at regional level to the regional bank account within three days

4.11.2.6 The Regional Commissar shall;
4.11.2.6.1 Be responsible for cadreship development and capacity building in the region.
4.11.2.6.2 Coordinate the work of cadreship development and training of branch educators or commissars.
4.11.2.6.3 Be responsible for gender work in the region.
4.11.2.6.4 Organise cadreship schools and capacity building workshops at regional level.

4.11.2.7 The Regional Organizing Secretary shall,

4.11.2.7.1 Be responsible for organizing and co-coordinating the structures of PUDEMO at regional level.
4.11.2.7.2 Be the convener of the Regional General Council
4.11.2.7.3 Coordinate the work of Branch Organising Secretaries.
4.11.2.7.4 At all times work in close liaison with the office of the National Organising Secretary.

4.12 The Sub-Regions of PUDEMO
4.12.1 There shall be THREE Sub-Regions of PUDEMO per Region, namely Northern, Central and Southern Sub-Regions.

4.13 The Sub- Regional Executive Committee (Sub)
4.13.1 There shall be an elected Sub- Regional Executive Committee in each of the regions in the country.

4.13.1.1 The Sub-Regional Executive Committee, hereinafter called the Sub, shall be constituted by the Sub-Regional Chairperson, Sub-Regional Vice Chairperson, Sub-Regional Secretary, SUB- Regional Deputy Secretary, Sub-Regional Treasurer, Sub-Regional Commissar and Sub-Regional Organizing Secretary.
4.13.1.2 The Sub-Regional Chairperson and Secretary of the Youth and Women’s League AT Sub-Regional Level shall be ex-officio members of the Sub-REC.
4.13.1.3 The Sub shall be responsible for the operations and activities of PUDEMO at Sub-Regional Level.
4.13.1.4 It shall meet once a month.

4.13.2 Duties of Members of the Sub-Regional Executive Committee
4.13.2.1 The Sub-Regional Chairperson shall;
4.13.2.1.1 Preside over all Sub-Regional Executive and Sub-Regional Congress or meetings.
4.13.2.1.2 Be the official representative of PUDEMO on sub-regional policy matters.
4.13.2.1.3 Sign all minutes of the Sub and sub-regional meetings after they have been passed as correct.
4.13.2.1.4 Delegate any of the above duties whenever s/he is unable to execute them

4.13.2.2 The Sub-Regional Deputy Chairperson shall;
4.13.2.2.1 Exercise all the powers and perform the duties of the Sub-Regional Chairperson whenever s/he is unable to act. In the event that both are unable to attend, the REC shall appoint anyone of its members to act.

4.13.2.3 The Sub-Regional Secretary shall;

4.13.2.3.1 Be responsible for the general administration and maintenance of PUDEMO’s records at Sub-Regional level.
4.13.2.3.2 Be responsible for the general conduct of the business of PUDEMO at sub-regional level and for giving effect to the instructions of the Sub-Regional Executive Committee and the Sub-Regional Congress.
4.13.2.3.3 Prepare and give reports on the general performance of PUDEMO at Sub-Regional level to the Sub-Regional Executive Committee and the Sub-Regional Congress.
4.13.2.3.4 Be responsible for the general correspondence of PUDEMO on Sub-Regional matters.
4.13.2.3.5 In liaison with the Sub-Regional Chairperson, convene meetings of the Sub-Regional Executive Committee and Sub-Regional Congress, and send notices, agenda and record proceedings of such meetings.

4.13.2.4 The Sub-Regional Deputy Secretary shall;

4.13.2.4.1 Deputize the Sub-Regional Secretary and carry duties entrusted to the office by the Sub-Regional Executive Committee.
4.13.2.4.2 Be responsible for recruitment, capacity building and cadreship development in the sub-region.

4.13.2.5 The Sub-Regional Treasurer shall;

4.13.2.5.1 Be responsible for the overall financial administration and up to date maintenance of financial records and statements of PUDEMO at sub-regional level.
4.13.2.5.2 Prepare and present annual statements of account to the Sub-Regional Executive Committee and the Sub-Regional Congress which shall be approved by an accredited firm of auditors as appointed by the Sub-REC.
4.13.2.5.3 Organize and be responsible for fundraising activity at sub-regional level.
4.13.2.5.4 Be signatory to all financial books of account at sub-regional level.
4.13.2.5.5 On receipt, deposit all funds of PUDEMO at sub-regional level to the sub-regional bank account within three days

4.13.2.6 The Sub-Regional Commissar shall;

4.13.2.6.1 Be responsible for cadreship development and capacity building in the sub-region.
4.13.2.6.2 Coordinate the work of cadreship development and training of branch educators or commissars.
4.13.2.6.3 Be responsible for gender work in the sub-region.
4.13.2.6.4 Organise cadreship schools and capacity building workshops at sub-regional level.

4.13.2.7 The Sub-Regional Organizing Secretary
shall,

4.13.2.7.1 Be responsible for organizing and co-coordinating the structures of PUDEMO at sub-regional level.
4.13.2.7.2 Be the convener of the Sub-Regional General Council
4.13.2.7.3 Coordinate the work of Branch Organising Secretaries.
4.13.2.7.4 At all times work in close liaison with the office of the Regional Organising Secretary.

4.14 The Branch Executive Committee

4.14.1 There shall be an elected Branch Committee at every established branch of PUDEMO comprising the Branch Chairperson, Branch Deputy Chairperson, Branch Secretary, Branch Deputy Secretary, Branch Treasurer, Branch Commissar, Branch Organizing Secretary, and the Branch Chairpersons for the Youth and Women’s Leagues shall be ex-officio members.

4.14.1.1 Branch Committee shall be responsible for the operational work and activity of PUDEMO at respective branch, including recruitment, education and implementation of PUDEMO’s Program of Action.
4.14.1.2 The Branch Committee shall give reports through its Branch Secretary to the Branch Meeting and Sub-Regional Executive Committee.
4.14.1.3 It shall meet once a month


4.14.2 Duties of the members of the Branch Executive Committee

4.14.2.1 The Branch Chairperson shall;
4.14.2.1.1 Preside over Branch Committee and General Membership meetings.
4.14.2.1.2 Be the official representative of the Movement at branch level.
4.14.2.1.3 Sign all minutes of the Branch Committee and Branch meetings after they have been passed as correct.
4.14.2.1.4 Delegate any of the above duties whenever s/he is unable to execute them.
4.14.2.1.5 Be signatory to all financial books of accounts at branch level.

4.14.2.2 The Branch Vice Chairperson shall;

4.14.2.2.1 Exercise all the powers and perform the duties of the Branch Chairperson whenever s/he is unable to act. In the event both are unable to attend, the Branch Committee shall appoint anyone of its members to act.
4.14.2.2.2 Control and co-ordinate all PUDEMO’s structures at branch level.

4.14.2.3 The Branch Secretary shall;

4.14.2.3.1 Be responsible for the general administration and maintenance of PUDEMO records at branch level.

4.14.2.3.2 Be responsible for the general conduct of the business of the PUDEMO at branch level and for giving effect to the instructions of the NEC, Regional Congress, REC and other organs of the PUDEMO.
4.14.2.3.3 Prepare and give reports on the general performance of the PUDEMO at branch level to the Branch Committee and the Branch Meeting.
4.14.2.3.4 Be responsible for the general correspondence of PUDEMO to the local, branch matters.
4.14.2.3.5 In liaison with the Branch Chairperson, convene meetings of the Branch Committee and membership; send notice, agenda and record proceedings of all such meetings.

4.14.2.4 The Branch Treasurer shall;

4.14.2.4.1 Be responsible for the overall financial administration and up to date maintenance of financial records and statements of the movement at branch level.
4.14.2.4.2 Prepare and present properly audited annual statements of account to the Branch Committee and General Meeting.
4.14.2.4.3 Organize and be responsible for fundraising activity at branch level.
4.14.2.4.4 Be signatory to all financial books of account at branch level.

4.14.2.4.5 On receipt, deposit all funds of the PUDEMO at branch level to the PUDEMO’s bank account within three days.

4.14.2.5 The Branch Commissar shall;
4.14.2.5.1 Be responsible for cadreship development and capacity building at grassroot level.
4.14.2.5.2 Shall organize political discussions at branch and unit level.

4.14.2.6 The Branch Organizing Secretary shall;
4.14.2.6.1 Be responsible for organizing and co-coordinating the structures of PUDEMO at branch level.
4.14.2.6.2 At all times work in close liaison with the office of the Regional Organizing Secretary

4.15 The National General Council

4.15.1 The National General Council shall be constituted by; The National Executive Committee of PUDEMO, National Leadership of the Leagues, Regional Executive Committees of the PUDEMO and Deployees by the NEC of the PUDEMO.

4.15.1.1 It shall be responsible for the general operations of the PUDEMO as with regard to the structures on the ground.
4.15.1.2 Shall meet every six months.
4.15.1.3 Shall be responsible to ensure effective implementation of programmes and campaigns of the organization.

4.16 The Regional General Council

4.16.1 The Regional General Council shall be constituted by; Regional Executive Committee of the PUDEMO, Regional Executive Committee of the Leagues, Sub-Regional Executive Committees of the PUDEMO and Deployees.
4.16.2 It shall be responsible for the general operations of the PUDEMO at Regional Level with regards to the structures on the ground.
4.16.3 Shall once meet every three months.
4.16.4 Shall be responsible to ensure effective implementation of programmes and campaigns of the organization.

4.17 The Sub-Regional General Council
4.17.1 The Sub-Regional General Council shall be constituted and have functions same as in 4.16 above at Sub-regional level.
4.17.2


ARTICLE 5: THE LEAGUES OF PUDEMO

5.1 Each League shall be represented by the President and the Secretary General to form part of the National Executive Committee.

5.2 Each League shall work to improve the general operations of the Movement in line with its terms of reference and objectives as shall be approved by the General Congress from time to time in accordance with the People’s Manifesto.

5.3 Each Secretary shall be responsible for the general affairs and running of his/her league and shall be expected to give reports to the NEC on an annual basis or as requested from time to time

Article 6: Integration of YL and WL within the local structures of the Movement.

6.1 The Regional and Branch Chairperson and Secretary of the Youth League shall;
6.1.1 Be responsible for organizing and coordinating the Youth structures, programs and activities at regional and branch level respectively.

6.1.2 Represent the Youth and coordinate the development and implementation Youth Policy and socio-economic and political schemes on the ground.

6.2 The Regional and Branch Chairperson and Secretary of the Women’s League shall;
6.2.1 Be responsible for organizing and coordinating the Women League, its structures, programs and activities at regional and branch level respectively.

6.2.2 Represent the Women League and coordinate the development and implementation of Gender Policy and socio-economic and political schemes on the ground.


ARTICLE 7: TERM OF OFFICE

7.1 Members to the NEC, REC, Sub-REC and Branch Committee shall be open to any registered member of the Movement without regard to race, colour, sex religion or social status, subject to the provision stated below.

7.2 The term of office for the CEC and NEC’s directly elected additional members and Secretary for International Affairs shall be four years.

7.3 Term of office of REC shall be two years.

7.4 Term of office for SUB-REC shall eighteen (18) months

7.5 Term of office of BEC shall be one year.

7.6 Members of the NEC, REC, SUB-REC and BEC can have a multiple term with no limit as long as they are democratically elected or are constitutionally in office.

ARTICLE 8: SUSPENSION FROM OFFICE.

8.1 A member of the NEC, REC, SUB-REC and Branch Committee or any subsidiary body thereof may be suspended by these organs if s/he;
8.1.1 Is convicted of an offence regarded not very serious to warrant a removal in terms of article 9 below, but not impedes his/her effectiveness and situation for office at a given time or
8.1.2 Is being investigated for a dishonest act within the PUDEMO or a criminal offence and as a result is remanded in custody, or
8.1.3 Fails to carry out his/her duties in line with these rules or any standing orders of the PUDEMO.

8.2 The period of suspension shall be viewed against the merits of each case before the said organs, but should not cover the whole term of office at any given time.

8.3 A penalty or fine may be imposed by the respective organ in lieu of suspension subject to the gravity of the matter in question

8.4 A suspended member or penalized officer may appeal to the General Congress or Extra-ordinary Congress.


ARTICLE 9: Expulsion and Termination of office

9.1 Notwithstanding the provisions of Article 8.2;
9.1.1 A member of the NEC may be removed from the office by the General Congress or Extra-ordinary Congress.
9.1.2 A member of the REC may be removed from office by the Regional General Congress or Regional Extra-ordinary Congress
9.1.3 A member of the Sub-REC may be removed from office by the Sub-Regional General Congress or Sub-Regional Extra-ordinary Congress
9.1.4 A member of the Branch Committee may be removed from office by the Branch General Meeting.
9.1.5 All decisions in terms of Article 9.1 shall require a two-third-majority vote based on the current register of existing delegates or eligible members.
9.1.6 A member of the,NEC, REC, Sub-REC, Branch committee or any subsidiary body thereof may be removed from office if s/he;
9.1.6.1 Willfully and without reasonable grounds acts in contravention of any provisions of the constitution or any rules and procedures made in accordance with the provision of the constitution or the People’s Manifesto or;
9.1.6.2 Is unfit to hold office in terms of conduct or mission especially after having been given written notice two times within any period deemed reasonable, or
9.1.6.3 Willfully or without reasonable cause fails to discharge any duties and responsibilities assigned in terms of this constitution or other relevant bye-laws, especially after having been given written notice two times within any period deemed reasonable, or
9.1.6.4 Is convicted of a criminal offence or any offence not linked to the activities and programmes of the PUDEMO.

9.1.7 A member of the NEC, REC, Sub-REC, Branch Committee or subsidiary body thereof shall cease to hold office if s/he;
9.1.7.1 Dies or resigns from office.
9.1.7.2 Is not re-elected into office, or
9.1.7.3 Is removed in terms of Article 8.1, or
9.1.7.4 Becomes of unsound mind and is declared unfit and incapable of acting in the capacity as an officer of the PUDEMO by an accredited medical practitioner.

ARTICLE 10: DISQUALIFICATION from Office

10.1 No member of the PUDEMO shall qualify to stand for elections for the NEC, REC, Sub-REC, Branch Committee or any subsidiary body of PUDEMO if;

10.1.1 Serving a suspension at any level and by any structure of PUDEMO including its Leagues.
10.1.2 Is not fully registered as a member of PUDEMO.
10.1.3 Is less than six months as a fully registered member of PUDEMO.
10.1.4 Has a bad public image and is unacceptable in society.


ARTICLE 11: MEETINGS

11.1 The General Congress;
11.1.1 Shall be convened once in four years.
11.1.2 Shall be convened by the NEC.
11.1.3 Shall comprise the NEC, and delegates elected by regions and the Leagues.
11.1.4 Shall have the right to summon any individual person or group of persons to attend for the purpose of giving full reports for a specific period. Such invited persons shall not be accorded any voting rights.
11.1.5 Shall require a quorum of two-third-majority to be able to start a meeting or take any resolution.
11.1.6 Shall meet as an Extra-ordinary General Congress when outside the provisions of this article.

11.2 The Extra-ordinary General Congress;
11.2.1 Shall be convened by the President, by giving not less than two weeks (fourteen days) notice.
11.2.2 Shall require a quorum of two-thirds-majority attendance to be able to start a meeting or to take any resolution.

11.3 Mid-term National Conference;
11.3.1 Shall be convened by the NEC by giving not less than two months notice.
11.3.2 Shall require a quorum of two-thirds-majority attendance to be able to start a meeting or to take any resolution.

11.4 The National General Council
The National General Council shall;
11.4.1 meet once in six months a year or as petitioned by two-thirds of its members or found necessary by the NEC.
11.4.2 consider matters referred to it by the REC.
11.4.3 responsible for the general operations of PUDEMO on the ground in the various organs of PUDEMO and all structures as required by the constitution.
11.4.4 Two-thirds of the members present at a meeting of the NGC shall constitute the quorum.

11.5 The Regional Congress
11.5.1 Shall be convened every two years.
11.5.2 Shall require a quorum of two-thirds-majority attendance of all formally registered branches.
11.5.3 Shall be constituted of delegates elected at branch level in proposition to its membership/numerical strength whose quota will be defined by the REC.

11.6 The Extra Regional Congress
11.6.1 Shall be convened by the REC.
11.6.2 Shall be convened every three months.
11.6.3 Shall require a quorum of two-thirds of officially registered branches in the region.

11.7 The Sub-Regional Congress
11.7.1 Shall be convened once in eighteen months.
11.7.2 Shall require a quorum of two-thirds-majority attendance of all formally registered branches.
11.7.3 Shall be constituted of delegates elected at branch level in proposition to its membership/numerical strength whose quota will be defined by the S-REC.

The Extra-Sub-Regional Congress

11.8 The Central Executive Committee (CEC)

The Central Executive Committee shall;
11.8.1 meet monthly to discuss matters related to the day to day running of PUDEMO;
11.8.2 discuss and resolve disciplinary and other issues referred to it by the NGC;
11.8.3 conduct the general business of PUDEMO in accordance with the duties as enshrined herein or as imposed upon it by the various organs of PUDEMO;
11.8.4 Four members present at any meeting of the Central Executive Committee shall constitute the quorum.

11.9 The National Executive Committee

The National Executive Committee shall;
11.9.1 Meet once in two months to discuss progress reports of the Leagues and the Programme of Action;
11.9.2 Require a two-third-majority of its membership to start a meeting or to take any resolution;
11.9.3 Meet to discuss any issues referred to it by the NGC, and the Regional Executive Committees;
11.9.4 Meet to discuss, plan and implement resolutions and campaigns.


ARTICLE 12: FINANCE

12.1 The funds of PUDEMO shall be lodged in a registered bank approved by the NEC

12.2 All funds and financial transactions of PUDEMO shall be accounted for to the General Congress by the NEC.

12.3 An annual budget shall be prepared by the NEC in accordance with the approved budget estimates of the General Congress

12.4 No expenditure shall be incurred which is not included in the approved annual budget without prior approval of the NEC.

12.5 The People’s United Democratic Movement may receive funds in the form of donations or aid from within or without the country.

12.6 The People’s United Democratic Movement may engage in fundraising activity as may be deemed appropriate by the NEC or its subsidiary structures from time to time.

12.7 The financial year-end of PUDEMO shall be decided by the General Congress from time to time.


ARTICLE 13: AUDITORS

13.1 The General Congress shall elect an accredited firm/s of auditors for a five-year term to audit the books of the Movement at national, regional and branch levels

13.2 The selected auditors shall have access to all books of account and shall examine every balance sheet and verify accounts and vouchers relating thereto and shall either sign them as found correct or shall report in what respect they find them to be incorrect, or not in accordance with the law

13.3 True copies of the audited accounts and the auditor’s report thereon, shall be handed over to the General Secretary of the Movement

13.4 Each firm of appointed auditors shall prepare a summary report for each of the five years it conducted auditing

13.5 The summary report mentioned in clause 12.4 above shall be presented to the General Congress

13.6 There shall be a group of four internal auditors who shall be appointed by the General Congress whose duties shall be as specified in Article 12.2, 12.3 and 12.4 above.

13.7 Internal auditors shall carry out such other duties as may be determined by the General Congress.


ARTICLE 14: ELECTIONS

14.1 The Central Executive Committee
14.1.1 The Central Executive Committee shall be elected directly for the stated positions by the General Congress.
14.1.2 The Central Executive Committee shall within one month of the elections form the governing body of the PUDEMO which is the NEC.
14.1.3 Elections of the Central Executive Committee shall be conducted every four years on the basis of one-person one vote. A bye-election shall be conducted in an extra ordinary General Congress in the event a member vacates office.

14.2 The Regional Executive Committee
14.2.1 The REC shall be elected by the regional organs at least one month before the General Congress on one person one vote basis.
14.2.2 Elections of the REC shall be conducted every two years on the basis of one-person one vote. A bye-election shall be conducted in the event a member vacates office in a regional Extra-ordinary congress.

14.3 The Sub-Regional Executive Committee

14.3.1 The S-REC shall be elected by the regional organs at least one month before the Regional General Congress on one person one vote basis.
14.3.2 Elections of the S-REC shall be conducted every eighteen months on the basis of one-person one vote. A bye-election shall be conducted in the event a member vacates office in a sub-regional Extra-ordinary congress.

14.4 The Branch Committee
The Branch Committee shall be elected by the members of each branch once every year on a one person one vote basis. A bye-election shall be conducted in the event a member vacates office


ARTICLE 15: VOTING

15.1 Voting shall at all times be by secret ballot; be it for purposes of elections or reaching a resolution.

15.2 Only elected delegates can participate in voting, who shall be Members of good standing according to subscriptions and valid membership status can vote.


ARTICLE 16: INTERPRETATION AND AMENDMENT

16.1 The General Congress shall be the upper most body for the purpose of interpreting and amendment of the constitution with a clear two-third-majority vote.

16.2 Nothing in these rules shall be interpreted contrary to the provisions of the People’s Manifesto or in contravention of Basic Human Rights.

16.3 For operational purposes, the NEC, sitting jointly can provisionally interpret any of the provisions provided herein pursuant to a decision by the General Congress

ARTICLE 17: LEGAL STATUS.

17.1 The organization, shall, upon winning the battle of the unbanning of political parties and assenting the norm of freedom of association, obtain legal status where it can sue and be sued.

17.2 The Secretary General or an officer duly mandated by the NEC shall therefore stand on behalf of PUDEMO in such cases as pertains this article.

17.3 Presently, the organization remains an underground movement of the oppressed people in the struggle for the freedom of the people of Swaziland.


ARTICLE 18: DISSOLUTION

18.1 The People’s United Democratic Movement shall not dissolve except by a two-thirds vote of the General Congress obtained by secret ballot.

18.2 In the event of PUDEMO going into dissolution, all liabilities shall be fully discharged and the remaining assets given to a succeeding organization or charity organization or the general membership through a cooperative scheme.
